Terms of Use

1. Parties and Scope

These Terms of Use ("Terms" or "Agreement") are entered into between KUTAY YAZILIM MÜHENDİSLİK ("Company", "we") and the individual end-user ("User", "you") who downloads, installs, accesses or uses the Bi Kahve mobile application ("App") or the bikahveapp.com website ("Site").

By downloading, installing, opening or otherwise using the App you confirm that you have read these Terms in full, that you understand them and that you accept them entirely, irrevocably and by electronic means. If you do not accept these Terms you must refrain from using the App and remove it from your device.

2. Definitions

• App: "Bi Kahve", an AI-powered coffee fortune reading mobile application available on iOS and Android.
• Service: All features, content and AI outputs offered through the App and the Site.
• Premium: Paid subscription plans granting access to additional features.
• Store: Apple App Store and Google Play Store.

3. Description of the Service

Bi Kahve allows users to upload photographs of their Turkish coffee cup and receive AI-generated, purely entertainment-oriented fortune readings. The App may also offer history of past readings, premium subscription features, push notifications and similar functionality.

The Company reserves the right to modify, suspend or remove any feature, pricing model or technical infrastructure of the App with or without prior notice.

5. Accounts and Security

Some features may require account creation. You agree to provide accurate, up-to-date and complete information when registering.

• You are solely responsible for the confidentiality of your credentials (username, email, password, verification codes).
• All actions performed through your account are your responsibility.
• You must notify us at info@bikahveapp.com immediately if you discover any unauthorised use of your account.
• Only one account per User is permitted; creating multiple accounts, impersonating others or providing false information is prohibited.

6. User Obligations

By using the App you agree to:

• Use the App only for lawful purposes and in compliance with these Terms.
• Refrain from uploading any content that violates Turkish law, public order, public morals or third-party rights.
• Not access the App via automated tools (bots, crawlers, scrapers).
• Not reverse engineer, decompile or create derivative works of the App.
• Not attempt to bypass security mechanisms of the App.
• Not harass, abuse or otherwise disrupt other users.
• Not use the App to distribute viruses, malware or harmful code.

7. AI-Generated Content

Content inside the App is generated automatically by machine learning and large language models. Accordingly:

• Content may contain inconsistencies, errors, omissions or fabricated information.
• The same image may produce different readings on different occasions.
• The Company makes no warranty as to the accuracy, consistency or truthfulness of the generated content.
• Readings should not be treated as personal advice; consult a qualified professional for health, legal or financial matters.

8. Subscriptions and Payments

The App is free to download but access to certain premium features may require a periodic (weekly / monthly / yearly) subscription.

• Subscription prices, contents and durations are displayed clearly within the App at the time of purchase.
• All payments are processed by Apple App Store or Google Play Store. The Company does not store or have access to your card details.
• Subscription fees are charged to the payment method linked to your Store account.
• The Company may change prices, promotions or plan features through the Store with notice.

9. Free Trial

The Company may offer free trial periods from time to time. If you do not cancel before the trial expires, your subscription will automatically convert to a paid plan and the relevant fee will be charged to your Store account.

10. Auto-Renewal and Cancellation

Your subscription renews automatically unless cancelled at least 24 hours before the end of the current period. The renewal fee is charged to your Store account within 24 hours prior to the renewal date.

Cancellation Methods

• iOS (App Store): "Settings > Apple ID > Subscriptions" — select Bi Kahve and cancel.
• Android (Google Play): In the Play Store app, go to "Menu > Subscriptions > Bi Kahve > Cancel".

Cancellation takes effect at the start of the next billing period. Amounts already paid for the current period are non-refundable; however, you retain access to subscription benefits until the period ends.

11. Refund Policy

Because all purchases and subscriptions are processed through the relevant Store, refunds are governed by the refund policies of Apple App Store or Google Play Store.

• Apple refunds: requested via reportaproblem.apple.com.
• Google refunds: requested via the Google Play Help Center.

To the extent permitted by law and given the nature of digital content delivered instantly, the Company is not obligated to provide refunds once the Service has begun to be used. Under Article 15 of the Turkish Regulation on Distance Sales Contracts, the right of withdrawal cannot be exercised for digital content delivered immediately upon User's consent.

12. Intellectual Property

All content of the App and Site — source code, design, logo, graphics, text, audio, the brand "Bi Kahve" and related slogans — is the property of KUTAY YAZILIM MÜHENDİSLİK and is protected by the Turkish Law on Intellectual and Artistic Works No. 5846 and applicable international treaties.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable licence to use the App on your personal device for non-commercial purposes only. Any other use, reproduction, distribution, derivative work, public communication or commercial exploitation is prohibited.

13. Usage Restrictions

The following activities are strictly prohibited:

• Decompiling, disassembling or reverse engineering the App;
• Copying, selling, renting, sublicensing or redistributing the App;
• Bypassing security features of the App;
• Presenting AI outputs on other platforms as "real fortune telling" or "prophecy";
• Reusing in-app content for commercial purposes without the Company's prior written consent.

14. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available". The Company does not warrant that it will be uninterrupted, error-free, secure or fit for any particular purpose.
• The Company shall not be liable for any direct or indirect, incidental, special, punitive or consequential damages (including loss of revenue, data, profits or moral damages).
• The Company is not responsible for any consequences arising from a User acting upon AI-generated readings.
• The Company's total liability shall in any event be limited to the amount paid by the User for the Service in the 6 (six) months preceding the claim.

15. Suspension and Termination

The Company may suspend, terminate or block User access to the App without prior notice or any compensation if the User breaches these Terms, applicable law or public order.

Users may delete their account at any time from within the App or by emailing info@bikahveapp.com. Upon deletion, related personal data is permanently removed, subject to the retention periods set out in the Privacy Policy and applicable law.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye.

The Istanbul (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction over any dispute arising from these Terms. For Users qualifying as consumers, the jurisdiction of Consumer Arbitration Committees and Consumer Courts within their monetary limits is reserved.

17. Amendments

The Company reserves the right to amend, update, add to or remove provisions of these Terms unilaterally at any time. Material changes will be communicated through the App or by email. The current version is always published at bikahveapp.com/en/terms.html.

Continued use of the App after changes constitutes acceptance of the updated Terms. If you do not accept the changes, you must stop using the App.

18. Force Majeure

The Company shall not be liable for any failure to perform its obligations due to events beyond its reasonable control, including natural disasters, epidemics, war, terrorism, riots, internet outages, cyber-attacks or governmental decisions.

19. Severability

If any provision of these Terms is found by a competent court to be invalid, illegal or unenforceable, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.
